Use of the site

Eligibility

Use of damanlottery.club (the "Site") is permitted only to individuals aged 18 or older who are legally entitled to participate in lottery activities under the laws of their place of residence. By accessing the Site, you confirm you meet these requirements. We reserve the right to verify your age and identity at any time and to suspend or terminate access where requirements are not met.

Permitted use

You may use the Site solely for lawful, personal, non-commercial purposes in accordance with these Terms. You agree not to deploy automated tools, bots, or scrapers; transmit unlawful or defamatory content; circumvent security or age-verification controls; or engage in conduct that disrupts the Site's operation. Any violation may result in immediate termination of access without prior notice.

Payments and transactions

Where the Site facilitates financial transactions, you must use only payment methods lawfully registered to you. Daman Lottery supports major Indian payment instruments including UPI apps such as PhonePe, Google Pay (GPay), and BHIM, as well as net banking and debit cards from scheduled Indian banks. You are solely responsible for ensuring your payment method is authorised and funded. Fraudulent chargebacks may result in account suspension and recovery proceedings under applicable Indian law.

Intellectual property

Ownership

All content on the Site, including text, graphics, logos, images, and software, is the exclusive property of Daman Lottery or its licensors and is protected under Indian and international intellectual property laws, including the Copyright Act, 1957, and the Trade Marks Act, 1999. Unauthorised reproduction or distribution of Site content, in whole or in part, may expose you to civil and criminal liability.

Limited licence

We grant you a limited, non-exclusive, revocable licence to view Site content for personal, non-commercial use only. This licence does not permit you to reproduce, sell, or exploit any Site content; create derivative works; remove copyright or trade mark notices; or frame or mirror the Site without prior written permission. Any use beyond this licence terminates automatically without notice.

Trade marks

The "Daman Lottery" name, logo, and all associated marks and slogans are trade marks of Daman Lottery. You must not use these marks without our prior written consent. All other trade marks and company names referenced on the Site belong to their respective owners and are cited for identification purposes only. Nothing on the Site constitutes a grant of any right to use any trade mark without the owner's express written consent.

Limitation of liability

No warranties

The Site and all content, tools, and information provided on it are made available on an "as is" and "as available" basis without warranties of any kind. Daman Lottery does not warrant that the Site will be uninterrupted, error-free, or free from viruses or harmful components. You access and use the Site entirely at your own risk.

Exclusion of consequential loss

To the fullest extent permitted by applicable Indian law, Daman Lottery and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of, or inability to use, the Site. Our aggregate liability for any claim under these Terms shall not exceed the amount paid by you to Daman Lottery in the twelve months preceding the relevant claim.

Statutory rights

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot be excluded under Indian law, including rights under the Consumer Protection Act, 2019. Where such statutory rights apply, they are preserved in full and unaffected by any exclusion set out in these Terms.

Governing law

Applicable law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them, including non-contractual disputes, shall be governed by and construed in accordance with the laws of India. Subject to the arbitration clause below, Indian courts of competent jurisdiction shall have exclusive jurisdiction to hear and settle any such disputes.

Dispute resolution

Where a dispute arises, both parties agree to first attempt informal resolution by contacting us directly. We aim to respond to formal complaints within 10 business days. If a resolution is not reached within 30 days, either party may refer the matter to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in India, conducted in English, with a final and binding award.

Consumer protection

These Terms do not affect your statutory rights under the Consumer Protection Act, 2019, the Information Technology Act, 2000, or any other applicable Indian legislation. Residents of India retain all rights under Indian consumer protection law, including the right to approach the appropriate District, State, or National Consumer Disputes Redressal Commission. Any provision inconsistent with mandatory law shall be read down or severed to the minimum extent necessary to achieve compliance.
